would be amusing if it wasn't so seriously Eff'ed up.
Is the drug problem in the US any worse than the UK, Germany, Canada, or the multitudes of other first world countries? yet most of them do not have compulsory drug testing outside of government and law enforcement (where government job is security based, not for secretaries in the tax offices). My impression of the US is that any company with over 50 employees wants to drug test all their staff.
My opinion is that Random drug testing is unconstitutional as it presumes guilt until proven innocent.
That being said, I agree that if a company takes a drug test, that the employee should be able to get a second opinion from an independent lab at the employers expense any time that the employer demands a test . If the tests do not agree, then the positive should be considered a false positive and thrown out with no penalty to the employee. Also the particular tests performed should under go critical assessment, to determine if there are positive results that are not from drug abuse such as prescription medications containing opiates or steroids (or even poppy-seed bagels as the MythBusters have shown).
A detailed history of the employee's medication should be considered (which will play hell with the privacy act in many states). |
