I disagree strongly with an employer having a right to demand drug testing as a condition of employment.

If there is a problem with an employee, address that as a performance problem. Manage your workforce by requiring certain minimum levels of performance. If drugs impair performance, then this will become evident as failing performance management. Drug testing is just an unwarranted intrusion into the privacy of the employee and should NOT be allowed as a condition for employment.

IMO drug testing is just a way for an employer to avoid the responsibility for proper management. If an employer can't manage their workforce, then they shouldn't be allowed to violate their privacy to compensate. They probably won't manage THAT well either.
