| IHMO: If an employee is required to take an on-the-spot drug test, that employee should have the right after the test to immediately leave the workplace to go to a licensed drug testing facility (e.g. a hospital) to get an independent test. Furthermore, when the employer initiates the test the employee should be given written notification of that right and a list of licensed testers in the area, that list having been compiled by the agency that does the licensing (not the employer).
Note that in some states the employer is already required to notify the employee of the right to an independent test if the employee fails the drug test. I believe the employee should have that right for all tests, and furthermore should be able to get the test immediately.
So say I. Opine. |
