Background checks will not completely prevent the "criminal element" from obtaining illegal weapons, however, background checks will make the "criminal element" work harder to get weapons, and given the intelligence of the average criminal, that extra effort will make it easier to catch them. And yet another point is that in many cases the background checks can prevent an unhinged (but previously non-criminal) individual from obtaining a weapon.
