INAL, but genes per se shouldn't be patentable, as they are a) products of nature and b) discoveries.

What seems to be done, is patenting the DNA made from copying such a gene. As this is artificially done, it's a product and can be patented. Sneaky, but apparently legal.

So in essence you can't be owned, but a copy of it can be.

It's like patenting a picture of you. You don't own you just because you made a picture, but you own the process of making a picture.
