I haven't heard anything about this recently, but before the tax was passed there was some discussion about consumers basically getting a license for downloading because of the tax paid on blank media. This discussion was before the political act of passing the tax, as far as I know it has not been used in a legal defense before the courts, so I do not know if there is a legal precedence. *Tax - maybe isn't the legal term for it. But it has the right connotations.
