is what is being pushed is not what the American people want. They would prefer the status quo to untold billions if not trillions more of their hard earned dollars being taken out of their pockets. Since lower income families are already eligible for subsidized health care that particular argument is a virtual non-starter.

Making insurance available across state lines would be something the US Constitution authorizes via the often abused commerce clause.

Tort reform would have to be carefully done. But it would not be impossible. Limiting suits to instances gross negligence, incompetence or malice would be one idea that has merit.
