set a pit trap using the portable hole and after he falls in, close it. After he suffocates, remove the body and retrieve the artifact. Out of curiosity, why was the heck was your DM thinking when he allowed a Evil character in the party? When I DM'd, the rule was no Evil or Chaotic Evil unless the entire party was evil.
