I believe they can ask a judge for a declaratory opinion and a permanent restraining order against the federal government preventing them from enforcing the law within the State of Texas.

This can be done without risking the Federal criminal penalties.

This is how the pot co-op cases in California played out. The situation there is that the DEA has violated the restraining order, and now the whole thing is in the Federal Appeals system.
