is a conflict of opinion - which cannot be settled by experiment. What happens? We, as humans, arbitrarily decide to impose a particular interpretation on this situation - which is only an opinion. We call that Rule of Law.

But that does not change the inescapable fact that the decision as to which opinion is valid is a human decision. It is therefore arbitrary. And being a human decision, it can be flawed. Which is why the Law is constantly being re-examined and is under constant scrutiny for its congruence with the greatest good.

Because the law is a human construction, it has the imprecision and uncertainty of all non-material constructs built on language. And we permit ourselves to be oppressed by this system, by common-consent, because we cannot (at least so far) devise a system that works any better.
