that going digital/analog/digital is not "bypassing" the copy protection. The RIAA seems to think that it is, and there's no guarantee that any given judge is going to disagree.

OTOH, the recorded-music industry is, IMO, setting itself up for a meltdown as more and more artists ditch the established channels in favor of direct sale. Very few have actually been getting anything from the sales of their recordings anyway, and a large number are apparently looking at the direct channel as a method of turning a lack of revenue into a small positive flow. A few enabling companies have already sprung up for the purpose of doing turnkey order fulfillment for them; pressing the non-CDR copies, producing the packaging, and shipping the orders for a flat fee. If an artist can actually make a buck per CD that way, it beats the heck out of the creative accounting by which the major labels have been finding ways to keep all the money for themselves.

Frankly, I think the dinosaurs will have to either accept reality and cope with it (which it's not presently clear that they can), or face mass extinction as the revenue stream falls below the threshold at which they can operate with their current business model. And given that they've ticked off so much of the rest of the world already, I doubt that they'll be able to buy any bailouts when things get really tight.
