I went to lunch and thought some more. I think what I need to remove the perceived conflict is a slight tweak to where rights are being claimed. Rather than only within a society, how about a relationship/interactions between 2 or more beings? Most of what we're familiar exists within a society so that's why I latched on to that term. A society seems to qualify as relationships between 2 or more beings.

Extending the idea this way allows for animal rights to be discussed without trying to make animals into people when they interact with people. It also makes room for relationships with alleged supreme beings.

I'm not sure if I would call "struggle for life" as a right. That action could take place independent of another being and be outside of where I think rights apply. Can abiotic factors violate rights? I don't think so. In my philosophy, I can't have a relationship with things like lightning. At least, not long enough for any rules to develop. ;-)
