A patent is an exclusive right to a process, most popularly attributed to an invention. While I know it can be applied to software as well, I'm not sure about the relationship between software and patents vs. copyright. I guess copyright would be the right to the source code itself, and the patent would be the right to how it does what it does? That seems kind of funky, though.

A tademark is an exclusive right a logo that identifies a brand.
