didn't make a mint. Or even any money at all. That's called fanfic, I think, and there are a lot of people who defend their "right" to play in someone else's playground without explicit permission.
(and I can't believe I'm defending fanfic, LOL).
What happens in the reality of your theoretical situation is this: the band, because people are sneaking in to concerts without paying for tickets, doesn't earn enough money to keep touring. The band then breaks up and stops performing as that particular entity.
Not earning enough to pay the musicians or rent the hall or pay for the sound guy or the lights was what killed my band. Plain and simple. I could no longer afford to shell out money to basically "entertain" my friends at my expense any more. (If I think about it for too long, I start to get angry, so I'll change the subject).
The possibility of control and ownership of one's intellectual and creative endeavors is one of the reasons people create the stuff in the first place. Othewise, what's the point of doing anything except building sand castles? Unless you decide that everything is work for hire from someone with money, which makes all artists slaves again. (and the person with money owns and controls the intellectual property - and "person" in this case can also be a corporation)
