Copyright v. Piracy: "It's not theft." by Illiad 2008-08-27 16:36:18
I happen to agree with this. Copying media is not theft. It's not a crime, as it has civil remedies. And, as we often hear and read, when copying media, nothing is "stolen," in the sense that making a copy of a work does not deprive the copyright holder of the use of that work.

Those folks who pirate software gleefully (and often with some strange sort of moral superiority) also point out that since they wouldn't have bought a copy of the game/music/software/work anyway, the copyright holder isn't losing anything.

I disagree with this. What this sort of pirate is essentially trying to argue is: "Since I never intended to pay for X, it should be okay for me just to take X. I should be permitted to enjoy X even if I didn't pay for it," where X = some product that likely has thousands of man-hours of work behind it.

Since entertainment is often the material in question, let's try a parallel. "Baked Goods" is a band that is moderately successful. It goes on tour, and puts on a live concert in Vancouver. The venue can hold 1,000 people. Eight hundred fans show up with paid-for tickets. Another hundred show up and sneak in without paying. Is what the hundred did okay because they never had any intention of paying for a concert ticket to begin with?
