There is no intent to deceive since the work is labeled "fiction".

Publishing a story claimed true with changed names may be unethical. It would depend on the nature of the story. What are the consequences of the deception? Would I attribute the criminal or victims as being other real people? In other words, is there any harm?

The status as a lie would change if the author also withheld any statement about the truthfulness of the story. Without a claim of truth, how would you claim "intent to deceive"? It seems strange to have a work where we don't know if it's fiction or nonfiction but that's what you describe.

Can you help me with the last 2 questions? I'm not sure exactly what "it" is by this point. What claims are being made or withheld?
