Until recently, federal law mandated a similar approach to wiretapping, allowing the government to issue wiretap orders but requiring the phone companies to install the taps. Under this arrangement, a phone company would be reluctant to act on a wiretap order it sus­­pected was illegal, because its compliance would make it vulnerable to both prosecution and civil liability.
