But as long as he respects the authority of the SCOTUS, is he as bad as someone who will deliberately try to avoid involving the courts in due process 'for the safety of the nation'. Whether a search (or detention, or whatever) is reasonable is something that the courts must decide. If the actions are deliberately withheld from the courts, it doesn't really matter what the Constitution says. Personally I'd prefer someone who respects the courts and their right to oversight.
