On one hand, I think the people who created Expelled are a bunch of evil deceptive f4heads who wouldn't know Truth if someone beat it into them with a 2x4.

On the other hand, I'm kinda glad to see fair use rights upheld, even for the most despicable. Think of the Falwell v. Flynt ruling; free speech (and fair use) aren't just for the popular and the intelligent; they're for everyone.

On the gripping hand, I don't think Premise's use of Imagine qualifies as fair use. They aren't commenting on the song itself, or anything related to the song. They use the song to comment on PZ Myers (who, last I checked, wasn't John Lennon).
