a 10 yo having sex with a 4/5 yo is still bad, even through they're underage. What the law attempts to do is protect adults from having sex with 14/15 yo's. However, by raising that, they're opening up the door for prosecution of a 16 yo with a 15 yo girlfriend. In an effort to exempt those (Romeo and Juliet Laws), they put in a 5 year spread so teenagers over with under 16 SO's won't get prosecuted for rape. The current argument is that 5 years is too much, because it would exempt a 16 yo from prosecution for having sex with an 11/12 yo.
