If you chose to give different vaccines to the kids, a lawyer could correctly argue that you knowingly chose a course of action which would certainly cause the death of one of the infants. The other choice had a 50% chance of saving both (and very few (perhaps no) medical treatments have a 100% chance of success in any case).
