§ 1201. Circumvention of copyright protection systems
(a) Violations Regarding Circumvention of Technological Measures.
(1)
(A) No person shall circumvent a technological measure that effectively controls access to a work protected under this title. The prohibition contained in the preceding sentence shall take effect at the end of the 2-year period beginning on the date of the enactment of this chapter.
(B) The prohibition contained in subparagraph (A) shall not apply to persons who are users of a copyrighted work which is in a particular class of works, if such persons are, or are likely to be in the succeeding 3-year period, adversely affected by virtue of such prohibition in their ability to make noninfringing uses of that particular class of works under this title, as determined under subparagraph (C).

Also, it is not (yet) established "fair use" to change copyrighted IP for personal use. As such, it is more likely than not a breach of copyright, especially in light of the World Intellectual Property Organization Copyright Treaty, which gives computer programs protection as literary works.
Also, there are 5 exclusive rights is US copyright, one of which is "to prepare derivative works based upon the work", which can or cannot be licensed. The EULA simply states what is licensed. IF you violate the EULA in these terms. To wit (mac OS X 10.5 license):
1. General. The software (including Boot ROM code), documentation and any fonts accompanying this License whether preinstalled on Apple-labeled hardware, on disk, in
read only memory, on any other media or in any other form (collectively the "Apple Software") are licensed, not sold, to you by Apple Inc. ("Apple") for use only under the
terms of this License, and Apple reserves all rights not expressly granted to you.
Granted rights: 2. Permitted License Uses and Restrictions.
A. Single Use. This License allows you to install, use and run one (1) copy of the Apple Software on a single Apple-labeled computer at a time.
B. Family Pack. If you have purchased a Mac OS X Family Pack, this License allows you to install and use one (1) copy of the Apple Software on up to a maximum of five (5)
Apple-labeled computers at a time as long as those computers are located in the same household and used by persons who occupy that same household.
C. You may make one copy of the Apple Software (excluding the Boot ROM code and other Apple firmware that is embedded or otherwise contained in Apple-labeled
hardware) in machine-readable form for backup purposes only; provided that the backup copy must include all copyright or other proprietary notices contained on the
original. Apple Boot ROM code and firmware is provided only for use on Apple-labeled hardware and you may not copy, modify or redistribute the Apple Boot ROM code or
firmware, or any portions thereof.
Ergo: A violation of copyright, as licensed (which I already said: Unless you are licensed to change it, you violate copyright). |
