because I don't think he has grounds to pull me over? It is now the responsibility of lawyers at telcos to decide how the Fourth Amendment applies to foreign counter intelligence?

The issue here is that telcos rely on federal licenses for their very existence. Whether or not that should be the case is immaterial here.

The choice the telcos were faced with is coperate and risk civil exposure, or don't and risc criminal prosecution and denial of the licenses that you need to conduct your business.
