there. They are both "electronic" but one is a wiretap (FCC) and one is a storage media.

As for your implied assertion of change needed, yes, but the change needed is in CONGRESS!!!! in the situation you link to and NOT the president! Read the first sentence in the article. :) "The U.S. Senate overwhelmingly passed a bill on Tuesday granting retroactive immunity from lawsuits to telecommunications companies that took part in President George W. Bush's warrantless eavesdropping program." You can not blame Bush for *CONGRESS* passing it...especially with the Democrats in control. :-D

The FCC laws do not apply AT ALL in the case of telecommunications for stored media UNTIL said media is sent over a communications device such as a Wireless NIC, Wired NIC , modem, or other such communications device.

While I disagree with the warrantless wiretaps the exemption of the telecommunications providers makes sense to me as they were only complying with a Federal Mandate in supplying the information and the multitude of cases that were filed with the courts will all be settled when the supreme court makes their ruling on it. This bill is designed to stop the influx of court cases being filed until they do make a decision.
