I don't know if they could confiscate the drive to copy it but I certainly wouldn't trust a border guard to know and follow anti-static precautions if they were to search your case.

If you want to remove critical files from your system and then put them back after crossing the boarder then burning them on to CD/DVD is probably the safest way. If you are really paranoid post the DVD to your destination rather than carry it. Searching physical mail is far harder to do legally than snooping on the internet or confiscating things at the border.
