  I have a large issue with this in that the info by Classic_Jon 2008-02-13 10:16:47
is not technically "in plain sight" if the PC or other device is powered down and requires a password to log into it.

To me that is like going to a locked door and kicking it down *without a warrant* because you can "see the door." If they wanted to look at my Cellphone etc they can try but I will request a warrant first for no other reason than that is how it should be done. I have nothign to hide on it but they can not just copy it for no reason. Look at it to make sure it is real. X-ray it?.. sure! look at my phone #'s and schedule...nope!
If more people did that then they might...just might! get a move on the courts making a decision on this subject. the more people knuckle under about it the more precident is set for them to allow it.

I will liken this to the woman that fought RIAA and won and is now trying to get a class action suit going agains them...all it takes is one person to stand up and win to change things.
