Article 9 of the Bill of Rights (which IS part of the Constitution):

The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.

The Constitution is written to enumerate the responsibilities and limits of the government, *NOT* for the government to dole out 'permission' which it has no authority to give to 'we, the people of the United States'. *ONLY* individuals have rights.
