IIRC, the US State Department has contracts with them to provide security for US government officials while off Embassy and Consular Grounds. This would automatically give them at least some protection under the Geneva Accords (not Geneva Conventions - these are where diplomatic immunities come from).

Howerver, Blackwater also contracts with international and Iraqi companies to provide private security. These would not be covered under diplomatic agreements. Since for security reasons, I'me sure they're none to keen to reveal who is or was in any particular convoy, it would be excruciatingly difficult to determine under what set of rules they should be operating at any given time.
