They have both departmental and judicial oversights civilians don't. Consider most dangerous situations, like highspeed chases -- there are strict procedures in place for situations like that, specifically for reasons like this.
as long as procedures are followed, they can get away with pretty much anything, which is as it should be. If something is wrong, the *procedure* should be changed, not the individual actions.
Additionally, *limited* power should be given to override procedures when necessary, and as far as I know, certain people do have that authority. They also assume the responsibility for something going wrong.
In this case, a *judge* ruled there was no case, based on what they had. This wasn't an internal thing that govt hushed/covered up. It went to the courts, as it should, and the court system overturned it.
