They way I *think* this particular instance would work is plaintiff sues for relief, DOJ argues that the law doesn't allow that, plaintiff argues that that portion of the law is unconstitutional. If the court agrees with the plaintiff on the unconstitutionality of that part of the law the suit is allowed to proceed. Of course DOJ is likely to appeal the ruling, but in many if not most cases the Court may choose to grant temporary relief to the plaintiff until the Constitutional issue is settled.
