The last estimate I heard of illegal aliens in the US was 16 million. This includes the alleged terrorist. Hence, he is in a pool of 16 million potential cases of illegal immigration. Immigration courts are known for being slow and overloaded.

They are also known for granting no-money bonds to illegals so that they don't need to stay in jail while waiting for their case to be called. That seems to be what is going on in this case.
