Whoever wins the popular vote gets ALL of that state's electoral votes rule/law... It pretty much equates to the same thing as your "California and New York elect our president". It's possible to win by a slim margin in 11 states, and lose by a landslide in the other 39 and still take the presidency. It's not likley but it could happen.
I'm not sure what the fair way to allocate the votes are, but the Maine method seems like it would work reasonably well. The method as I understand it is, whoeever wins the race in each congressional district gets one of the electoral votes. Whoeever wins the popular vote for the entire state gets the two remaining electoral votes.
Granted for states with only 3 or 4 votes, the result would likely be the same, but for states with larger numbers of votes like California, Texas and New York, I think you'd start to see some very different numbers. It'd make the close races in some of the swing states a lot more interesting to say the least.
I think people would feel better about the result if you didn't see states with large electoral vote counts and close races have such a gigantic impact on the election. It's hard to say, "My voice was heard" when all of the votes from your state go to the guy who wins the state by the skin of his teeth. Especially if he's not the person you voted for.
How different would the elections be if instead of winner takes 20 votes in Ohio was more like winner takes 12 votes...
And I think you'd start to see electoral votes cropping up for folks who aren't in the two primary parties.
