But they are generally the only "unique" information that can be used to keep track of a specific licence, and give the company some method of disabling the most commonly used (cracked and available online). Your argument that they are cracked in almost every case should not have an impact on their legality.

That same argument could be used on ANY security feature... Deadbolts can be picked in almost every case so following your argument does that make locking your front door illegal? How about anti-virus programs (or firewalls/etc) none of them are 100% effective - so why not make them illegal too? While I'm at it... airport's, military bases, etc security is cumbersome, unjust, and as easy to penetate as a licence key - so lets make them illegal too.

Having the company required to replace damaged media... is just going to push the retail prices even higher, as the company has to make the extra money up front to store and mail out all the past versions of all past products.
