Therefore it wasn't his, especially if he got a copy of the memo (or even if the colo did - that can be subpenoed). In addition it is absolutely incomprehensible that a professional webdesign company didn't have backup procedures in place, or that the colo didn't.

Either way, he was getting paid a salary - they owe him that. It's Federal law unless they had specific reason to believe that he sabotaged the company.

He better have everything documented though: he has to prove wrong-doing on their part, not the other way around.
