A person is not legally required to take action to prevent harm from coming to another.

The classic example I've heard is that you can stand on the side of a river with a rope and watch somebody drown without throwing them one end of the rope without bearing any legal responsibility for their death.

On the other hand, if you throw them the rope and they become entangled in it and drown, now you am legally responsible for their death.

This is the reason why "Good Samaritan" and "Hold Harmless" laws have been passed over the years -- to protect those who in good faith try to help someone who is in serious danger.

That said, there has been a tendancy lately towards laws requiring people to act in certain circumstances (mandatory reporting of child abuse for one).
