coupled with the Privacy of Information Act (or the equivalent in the country in question) would determine where liability lies.

From what I understand in Canada (IANAL) unless the T&C gives explicit permission to whoever manages the Card use the collected information in this situation, then they are legally forbidden to use the information in any way other then as explicitly prescribed in the T&C.
