There is a severe danger to the health of a person. BuySmart, i.e. their employees, know. They allow Joan to die though it would have been possible, feasible and reasonable to save her. Killing by omission.
BuySmart as a company has not really caused a monetary damage to Joan's husband, so I don't think they should be liable for compensation in the first place. The people running the shop OTOH have committed a crime and should be held responsible for that (Be stuck in the dock, not be stripped of their valuables). In case BuySmart company has contributed to the crime, maybe by setting up a policy of not helping customers in danger, they should be held responsible for that.
Everybody involved in the killing should be liable for damages according to their contribution, i.e. probably all claims should go against Snappy Inc. |
