Of course the above is limited only to "juvenile products, small household appliances, and certain other consumer products" and not food.

As a member of the jury for the case above I would find for the Defendant. Mainly because of the precedent it would set for all retailers. I think, almost immediately, the concept of a BuySmart Card would evaporate and with it all the savings and efficiencies gained from their use.

Where is the line drawn between acceptable risk and negligence? I, personally, draw the line MUCH closer to the individual (i.e. nearly everything that happens to you in life is a result of acceptable risk). In fact, I abhor those who sue at the bump of fenders. Was I rear-ended? Was the person drunk/high/engaged in Friday behavior/asleep? Regardless, so long as their insurance covers my injuries and recovery, the need for a lawsuit is unnecessary. If anyone would require suing, it would be an insurance company refusing to cover my bills.

I am probably hopelessly naive or willfully optimistic. In any case, I believe the individual has the greater responsibility for her own well-being than does any purveyor of goods/services. If you die from salmonella poisoning, I happen to believe that you were earmarked long before you ate the Salmon Mousse.
