Only somebody captured while actually doing espionage and not wearing an uniform will loose his/ her POW status. And therefore wouldn't be subjected to the rules, i.e. can be tried by a military court (and possible be shot).

So if Hicks was caught while pretending to be an Aussie and sneaking into the Embassy, he's a spy.
If he was caught guarding a tank he's an combatant (there is a section that deals with combatants not wearing an uniform. Carrying a weapon is enough distinguish apparently).

But INAL and I guess more proficient people than us have argued abotu this :)
