For the sake of the argument, I'll grant your point that Mr. Hicks felt under US jurisdiction at the point of his capture.
Then he is either a POW and has to be treated like one or he is a suspected criminal and has to be granted the rights every suspect has under US law. Neither is happening, and that holds true for all Gitmo inmates.
That is either a breach of international law or a breach of US law, depending on how you look at it.
