Which makes it a whole different ball-game, and the potential subject of a whole lot of debate. Criminal acts committed by private citizens in a host nation are routinely prosecuted by the host nation. Mr. Hicks was not an agent of the Australian Government at the time of his capture, he was a private citizen who (allegedly) wanted to be a terrorist.
