If the law says employers have a duty of care, it means that *all* employers have a duty of care.
Not just those who do the essentials - everybody.

Your point about unskilled labour being less 'pushy' is valid though - this is why there are so many accidents and deaths in the agricutural and construction industries.
The workers *need* the money, and know that they could be fired on the spot because there is a reasonably large pool of unskilled labour in many places - so they keep quiet about safety violations.

Therefore, the government must step in - the workers need to be absolutely certain that something will be done before they'll dare raise something.

I've been in a similar situation, and know people who were extremely lucky not to be seriously injured because of this.
