By implication, the persuit of happiness can not infringe on the right to life, which is of a higher order.

If it makes you happy to run around killing people (which obviously infringes on people's right to life) - the declaration of independence is not granting you immunity. Persuing happiness and taking actions that infringe on people's rights are two different things.

If you want to persue happiness in a way that does not infringe on other rights, go for it!
