authorized to work outside our borders. Conversely, our military is banned from being deployed within our borders (which is why the national guard is used -- they're state-level, not federal).
Regardless of who attacked the US, whether it was an official declaration of war by a foreign power by it's military, or a civilian with a personal grudge, if the ensuing action is outside the borders and territories of the US, the military are the only ones allowed to deal with it.
The intelligence agencies fall under a somewhat different catagory for the most part, but even they use the military (particularly spec ops teams) when they have to engage in force.
The only times our police force is used outside the US is in collaboration with the police of another country, and with their permission.
