| Consider: as a parent, I wanted my children (all six of them) to receive a good education. Teach my kids English? Sure, as long as the teacher is proficient in the language. Teach my kids mathematics? Again, as long as the teacher is fully versed in the subject matter.
Teach my kids art? My children will be taught art by an artist?! Oh, noes!! He'll fill their heads with all sorts of unconventional, unnatural ideas! He'll teach my children to think in ways other than those I wish them to learn!
After all, what'd the government expect, trying to teach kids art? Art! Totally useless! Waste of money, all so that a bunch of left-wing commie hippie artsy-tartsy types can get a warm fuzzy knowing they've wasted my child's time and my tax money.
In closing, yes the teacher's constitutional rights supercede any government agency's policies (this appears to have occurred at a public school). Once upon a time, this would've been considered black-letter law; nowadays it's hard to tell. |
