That oft-quoted phrase was in the pre-amble to the Declaration of Independence, NOT the Constitution. That phrase is not actually codified into US law. It's flowery political sentiment. :) Check the 5th amendment where it says no one shall be deprived of life, liberty or property without due process of law. It also says nothing about the State feeding your sorry self if you are unemployed, or paying for your meds if you are sick.

You can argue that those are worthwhile things, but when people justifiy it, they quote "life...liberty...pursuit..." as some sort of mantra when it doesn't really have the force of law. :P

Secondly, law is meant to deal with what one person does, or does not do, to another. Any human being with normal instincts would think a father is neglectful if he does not run into the burning building to save his kids (assuming there's a chance they're still alive), but the kids don't necessarily have the "right" to survive what amounts to bad circumstance (if the father was somehow responsible for the fire, different debate).

Re: the crack baby- "the law" does not recognize that baby while in the womb, and while the damage is being done. Yeah, babies have no rights.

The villagers- war on its face is a gross violations of rights/liberties; really to expect any "better" treatment of villagers and civilians is idealistic folly. War is nasty. Get out of the way if you can. You can try to shame combat forces into observing some minimum standards of decency, but do you really expect that out of the people who declared it in the first place? Even if they DO make the effort, their first priorities are keeping themselves alive (a.k.a. shoot anything suspicious), and complete the mission.

You may remember subbywan ticking off a lot of people a few months back by arguing that our rights are only as good as what is granted to us by our fellow man, NOT the ones we appeal to by higher moral/divine authority. The uncomfortable truth is that we have much fewer "rights" than we think, and we can't afford to be passive about them. It's up to the individual to defend himself.
