use the death penalty when it can reasonably assure that it will only hand that sentence to people who actually deserve it. If it can't do that, it has no right to employ the sentence.
The justice system in the U.S.A. is far, far, far from being able to reasonably make that assurance. You may think we don't use it enough, but the truth is we hand it out like candy when you consider how many times we then have to say "whoops, nevermind."
You may want to look at some of the previous times we've discussed it on the board, and the research that was sources therein - here (data showed up here), or here, or here (which continued here), for example.
Long story short (except it's not, as you'll see if you click those links - it's extremely long), we suck at putting only guilty people behind bars, or assigning appropriate sentences to those who are guilty. Until we can do that better, we have no ethical right to be killing people. |
