948a. Definitions `(1) UNLAWFUL ENEMY COMBATANT- (A) The term `unlawful enemy combatant' means-- `(i) a person who has engaged in hostilities or who has purposefully and materially supported hostilities against the United States or its co-belligerents who is not a lawful enemy combatant (including a person who is part of the Taliban, al Qaeda, or associated forces);

section 2, which allows the president ("under the Constitution of the United States and laws of the United States" ) to "establish military commissions for areas declared to be under martial law".

sec 950p lists a bunch of offenses that can take *anyone* out of the civilian criminal justice system, and subject them to "military commission"

949j, a: "Defense counsel in a military commission under this chapter shall have a reasonable opportunity to obtain witnesses and other evidence as provided in regulations prescribed by the Secretary of Defense." -- rumsfled can decide what material the -defense- can use in a trial, NOT the procesution, the defense is defacto prohibited from using info unless it's ok'd.
