you have all of the necessary info to get access to the account, as long as the company in question has practiced "due dilligence" in validating the info they have then the only person doing something illegal is the person commiting identity fraud. Pretexting is just another way of saying "identity theft, Fraud, Impersonation, and Social engineering." It is not legal at all, and in fact is against the Federal Right to privacy act not to mention several others.
This is why we make a very large point of NOT acting as if we are the customer when we research a payment with a company. We make it VERY clear who we are and what we are doing to comply with many govt. laws and acts. (Most notibly the Right to privacy act.) Impersonation is illegal, and more so if you actually try to do something on the account or request records. The FCC frowns on that highly...to the point of legal action.
This has been around a long time but is just now becoming a media sensation. |
