I don't know anything about the situation beyond the link he posted and won't pretend to, but a newspaper reporting on the government doing something under the wire does not mean the public was kept informed about the government's policies or actions. Your statement is about as logically solid as saying that prison conditions in Iraq were "open to public scrutiny" because the media found out about and reported on Abu Ghraib. :-p
